Most casual promises do not sound important when they are made. A tenant points out a dripping faucet during a walkthrough and you say you will take care of it next week. A tenant asks for a little extra time on rent and you say you can work with them. A prospective tenant asks whether the living room will be painted and you say yes before you have even called the painter.
The problem is not that landlords should stop being helpful. The problem is that a casual promise can become evidence of what the tenant says was agreed. If the details were never written down, the dispute becomes a contest over memory.
A Written Lease Does Not Make Verbal Conversations Irrelevant
Many Texas leases contain language stating that the written lease is the parties’ agreement and that changes should be in writing. That language is important. It does not mean a landlord should assume everything said outside the lease can simply be ignored.
Oral statements, later conduct, acceptance of payments, written messages, and a tenant’s reliance on a representation can all become part of a dispute over waiver, modification, or what the parties actually did. Whether an oral promise is enforceable depends on the facts and the law that applies. The better business practice is to avoid creating that argument in the first place.
Repair Promises Are Easy to Overstate
Repair conversations are a common example. If an air conditioner stops cooling in August, a landlord may want to reassure the tenant by saying, ‘It will be fixed tomorrow.’ But if every HVAC company in the area is booked or the system needs a part that is not in stock, that sentence can create a problem you did not need.
A better response is factual. Confirm that the request was received, say when the vendor was contacted, give the appointment window you actually have, and promise the next update rather than a result you cannot control. The same approach works for plumbing, water heater, irrigation, and storm repairs across San Antonio and South Texas.
Financial Accommodations Need Exact Terms
Payment arrangements create even more risk when they stay informal. If you agree to accept partial rent, move a due date, waive a late fee, or pause enforcement while a tenant catches up, put the agreement in writing. State the amount, the deadline, whether a fee is being waived, and whether the arrangement applies only to that month.
That record matters because later acceptance of money and other conduct can affect an eviction or collection dispute. A landlord should not create a payment arrangement casually and then assume the original lease can be enforced as though the conversation never happened. If the situation is headed toward eviction, that is a good time to get legal advice before accepting or promising something that changes the strategy.
Promises Made Before Move In Matter Too
Prelease statements deserve the same care. If you promise new blinds, a repaired fence, fresh paint, a refrigerator, or another improvement as part of getting the tenant to sign, put it in the lease, an addendum, or another clear written agreement. Do not leave an important move in condition resting on a conversation at the showing.
Permissions deserve the same treatment as promises. A tenant may ask to install a television mount, add a water softener, keep a trailer temporarily, paint a room, or make another change that sounds minor during a phone call. If you approve it, define the conditions in writing. State whether the tenant must use a qualified contractor, whether the change must be removed at move out, who is responsible for damage, and whether the landlord is contributing any money. A simple written approval can prevent a later argument over whether the landlord approved the work itself or only agreed to discuss it.
Make Fewer Promises and Better Records
That extra detail is usually worth far more than the few minutes it takes to write it down.
Professional communication does not mean saying no to every request. It means separating what you hope to do from what you are actually committing to do. When you do make a commitment, write down the scope, timing, and conditions. That habit is especially valuable for small landlords because one misunderstood promise can consume far more time than the minute it would have taken to document it correctly.
